What Happens If I Miss the Deadline to File My Certificate?
If you miss the deadline to file your certificate with the bankruptcy court, the court may close your case without granting a discharge. This means your debts would not be eliminated. Contact your attorney immediately if you have missed or are at risk of missing your deadline.
What the Court May Do
Close the case without issuing a discharge order
A closed case without discharge means qualifying debts are not eliminated
You would need to pay a court filing fee to reopen the case
Even after reopening, you must still file the certificate and Form 423 before discharge can be granted
This Is a Legal Issue — Contact Your Attorney
